Terms and Conditions of booking and attending events

1. These terms

1.1 What these terms cover
These are the terms and conditions under which You will be able to book and attend an Event organised by Mathematics in Education and Industry (hereafter, ‘MEI’, ‘We’, ‘Us’, ‘Our’).

1.2 Why You should read these terms
Please read these terms carefully before You book an Event. These terms tell You who We are, how You register/book and pay for the Event, and how You or We may cancel the Event or Your attendance at it. These terms also set out what the expectations are of both You and Us at the Event, as well as other important information.

1.3 Our contract with You
The contract between us allowing You to book and attend the Event comprises these terms and conditions, together with the details set out as part of Your online registration (which includes information about, in particular, the cost of the Event) (the Contract). The Contract comes into effect when You submit Your online registration. This Contract is between You and Us. No other person shall have any rights to enforce any of its terms.

1.4 Are You a business or a consumer?

In some areas You will have different rights under these terms depending on whether You are a business or consumer.  These terms make clear where that distinction is relevant.  You are a consumer if:

  • You are an individual; and
  • You are buying services from us wholly or mainly for Your personal use (not for use in connection with Your trade, business, craft or profession).

If You are not a consumer, You are automatically a business customer (even if You are acting on behalf of a non-profit-making educational establishment).

1.5 Are You booking for others to attend the Event?
If You have made a booking for other individuals to attend the Event (for example, where You are a school making a booking for specified teachers to attend the Event), You must make sure that the individuals attending the Event comply with these terms and conditions. You should therefore make sure they understand and accept these terms before You complete the online registration.

2. Use of defined words which have particular meanings

2.1 Consumer: has the meaning given in clause 1.4 above.

2.2 Content: means all presentations and teaching, learning or training materials provided to You during the Event.

2.3 Event: means the event or course organised by MEI that You are applying for, as detailed on the MEI website (https://mei.org.uk/), or the Advanced Mathematics Support Programme (AMSP) website (https://amsp.org.uk/)

2.4 Event Outside of Our Control: means an event which is beyond the reasonable control of MEI. Please bear in mind that this includes any imposition of national or local restrictions (e.g. in the case of a widespread pandemic similar to Covid-19).

2.5 Fee: means the fee that You must pay to attend the Event, as detailed on the MEI or AMSP website.

2.6 Venue: means the venue at which the Event is to take pace, as detailed on the MEI or AMSP website or subsequently communicated to You in writing by MEI.

2.7 Writing: when We use the words “writing” or “written” in these terms, this includes emails.

3. Information about Mathematics in Education and Industry (MEI) and how to contact Us

3.1 Who We are
MEI is a private company limited by guarantee established in England and Wales. MEI’s company registration number is 03265490 and our registered office is at Monckton House Epsom Centre, White Horse Business Park, Trowbridge, Wiltshire, BA14 0XG. MEI is a registered charity in England and Wales under charity number 1058911.

3.3 How We may contact You
If We have to contact You, We will do so by telephone or by writing to You at the email address or postal address You provided to Us in Your registration.

4. Registration for an Event

4.1. By submitting an online registration, You acknowledge and accept these terms and conditions and confirm that the information You submit is accurate, true and complete.

4.2 Following Your submission of an online registration, We will send You an email confirming that Your registration has been received.

4.3 We reserve the right to reject any registration request received, but will act reasonably in doing so. We will notify You by email if a registration is rejected. In those circumstances, the Contract between us will be cancelled with immediate effect, and We will refund in full any Fee that has been paid.

4.4 You will receive full details of the Event, including joining instructions and any other information which We think You will need in order to participate in the Event, via email to the email address provided on the registration form.

4.5 If You are applying for Our Teaching A level Mathematics (TAM) course:

a) Places will only be offered to teachers who have AS/A level or IB Mathematics teaching on their timetable. This teaching should include the teaching of some pure maths content within AS/A level or IB Mathematics (i.e. not only statistics and/or mechanics content).

b) Your AS/A level or IB Mathematics teaching (or the teaching of the relevant individual(s) being registered for the TAM course) must be timetabled lessons to an entire class for at least 2 hours or 2 lessons per week for the whole academic year in which You (or the relevant teacher(s)) are doing the TAM course. You (or the relevant teacher(s)) must be the member(s) of staff with sole responsibility for planning and teaching these lessons each week.

c) You should also be aware that if this teaching does not materialise or is withdrawn at any stage in the academic year, You would have to withdraw (or, if You are registering on behalf of others, You must ensure that the relevant teacher(s) withdraw) from the course and no refund would be made.

d) If You are unsure whether Your proposed teaching (or that of the teachers on behalf of whom You are registering) will satisfy these requirements, then please contact  Our customer service team with Your query either on 01225 776776 or via teachersupport@mei.org.ukbefore registering for the course.

5. Fees and invoicing

5.1 The Fee that You agree to pay for attendance at the Event is set out in Your online registration. After Your online registration has been confirmed, We will send you an invoice for the Fee, as per Your instructions in Your online registration.

5.2 The Fee must be paid within the time frame detailed on the invoice. If the Fee is not paid by that date, MEI will be entitled to cancel Your attendance at the Event. Any such cancellation will be notified to You by email, to the same address to which the invoice was sent.

    6. Cancelling the Event or Your attendance at it

    6.1 If You are:

    a) a Consumer, You may cancel Your attendance at the Event within 14 days of receiving the confirmation email from Us. To exercise this right of cancellation, please send confirmation in writing to admin@mei.org.uk, or use the cancellation form provided at Appendix 1 to these terms. In these circumstances We will refund any amount that You have already paid to Us. If the Event begins within this 14-day period, You accept that Our services to You will begin before that period ends, and in those circumstances You will no longer have the right to cancel under this clause 6.1(a). We will not refund Your Fee if You cancel Your attendance after the Event has taken place (or, if the Event runs over multiple dates, after the Event has begun).

    b) not a Consumer, or You are a Consumer and Your 14-day cancellation window has passed, You are not entitled to cancel Your attendance at the Event. However, if You notify Us that You no longer wish to attend the Event within the time frame detailed on the application form or in subsequent communication for the Event, We may, at Our sole discretion, agree to cancel the invoice or provide You with a full or partial refund, where We consider it reasonable to do so.

    6.2 Full details about time frames for notifying us if You are no longer attending (see clause 6.1(b) above) can be found on the application form for Your event and/or the confirmation of booking email. To enquire about arrangements for cancellation please contact admin@mei.org.uk. In considering whether to issue a refund under clause 6.1(b), We will have regard to whether We are able to allocate Your place to someone else, and to any unrecoverable costs to MEI which arise as a result of that cancellation.

    6.3 Free Events. If You no longer wish to attend a free Event, You may notify Us at any time that You no longer wish to attend, but We would appreciate as much notice as possible (so that We have the opportunity to offer Your place to another participant).

    6.4 Subsidies. Please note that in cases where an Event attracts a subsidy, payment of the subsidy is normally conditional on Your attendance. If You fail to notify Us of non-attendance, You agree to forfeit the payment of any applicable subsidy.

    6.5 Refusing applications. We reserve the right to refuse further applications from schools/colleges whose teachers repeatedly fail to notify Us that they will not be attending, or where they cancel too close to the date of the Event for their place to be reallocated.

    6.6 Transferring a place. In some circumstances, it may be possible to transfer Your registration for an Event to another person (normally a person also employed at the same school or college). Please contact admin@mei.org.uk as soon as possible to request such a transfer. We reserve the right to refuse a transfer if it is not practical to action, or where the transferee does not meet any requirements that are necessary for attendance on the Course. Please note:

    a) Places on Extended Professional Development Courses for Teachers are never transferable.

    b) Professional development subsidies are not normally transferable, but please enquire with the Course lead should this be relevant to You.

    6.7 The Event is subject to cancellation or postponement at Our discretion. This includes where an Event is under-subscribed. If We cancel or postpone the Event (other than where the Event is cancelled or postponed due to an Event Outside of Our Control), We will notify You by email as soon as possible and You will be given the option to cancel your booking and receive a refund in full.

    6.8 Events Outside Our Control

    a) If an Event Outside of Our Control occurs, which results in Us being unable to hold the Event as planned, We will take reasonable steps to rearrange the Event to another date and/or another location, and will notify You of the rearranged Event. Depending on the circumstances, those reasonable steps may include hosting the Event as an online Event, rather than in-person.

    b) If We have to rearrange the Event as a result of the occurrence of an Event Outside of Our Control:

    i. If You are a Consumer, You will be entitled to either attend the rearranged Event, or to cancel Your attendance at the Event and receive a full refund of the Fee that You have paid;

    ii. If You are not a Consumer, You will be entitled to attend the rearranged Event. If You choose to cancel Your attendance at the Event instead, MEI will refund You a reasonable proportion of the Fee that You have paid (having regard to any unrecoverable costs to MEI which arise as a result of Your cancellation). The amount of any such refund will be at Our discretion.

    6.9 Other than for a refund of the Fee as set out in this clause 6, We accept no liability to You for any losses incurred by You (including but not limited to any expenditure such as travel expenses, teacher release or any loss of income) that You incur as a result of Us cancelling, postponing or altering the Event.

    7. Our requirements of You at the Event

    7.1 When attending the Event, You must ensure that You observe all rules and instructions relating to the use of the Venue which We or the Venue make known to You. You must follow any relevant guidance or instructions on any equipment, signs or notices, and any parking guidelines, and comply with any policies or procedures that We or the Venue make known to You.

    7.2 Where any equipment or facilities are made available to You at the Venue, You must use those equipment and facilities responsibly at all times and in accordance with any instructions provided.

    7.3 You will be responsible for the costs of repair and replacement of any damage and breakages that You cause at the Venue, and You must promptly report any damage, breakages or losses that occur or that You become aware of at the Event.

    7.4 You must not act in an improper, rude or disorderly manner towards staff, or any other users of the Venue, and You must treat all staff at the Venue and other attendees with respect.

    7.5 Student attendance.

    a) Students attending an Event are expected to behave in a respectful way towards each other and all staff and speakers at enrichment events. Unacceptable or inappropriate behaviour from unaccompanied students may result in their school being refused places at other MEI events.

    b) Students up to age 16 must be accompanied by their teachers who remain in loco parentis at all times and are responsible for their students’ safety.

    c) An emergency contact number is required when students are unaccompanied. For group bookings this should be a school number. For individual bookings this can be either a school contact or a parent/guardian.

    7.6 You must not take pictures and post to social media, without first seeking permission from the Event organiser.

    7.7 If You break these rules, or any other requirements of You which are set out in these terms, You may have to compensate Us, and We may not permit You to attend future events organised by MEI.

    8. Content and Intellectual Property

    8.1 Copyright and all other intellectual property rights in all Content is owned by MEI or its licensors, or by presenters at the Event who produce that Content. You will not acquire any right, title or interest in any intellectual property rights in that Content.

    8.2 The Content is provided on an “as is” basis without any warranties of any kind (express or implied). MEI excludes to the fullest extent permitted by law all liabilities, costs, claims, damages, losses and/or expenses arising from any inaccuracy or omission in the Content.

    8.3 The Content may comprise educational resources which have been developed by us or on our behalf. You may use those educational resources:

    a) for Your personal use; or

    b) where You are a teacher, for Your use in the teaching of students in Your school or college.

    8.4 You must not use any part of the Content (including, in particular, any educational materials) other than for the purposes described above. In particular, You must not use any part of the Content for commercial purposes.

    8.5 You must not modify any Content that is made available to You in any way other than for Your own personal use or for use when teaching students in Your school or college. Where You do modify such materials, any intellectual property rights in those modified materials shall be deemed assigned to Us. You must not use any illustrations, photographs or any graphics separately from any accompanying text, without Our prior written consent.

    8.6 Our status (and that of any identified contributors) as the authors of all Content must always be acknowledged.

    8.7 Any access to MEI’s online learning platform, Integral, provided as part of the Event is subject to Integral’s terms and conditions, available here; this includes but is not limited to the following statement (capitalised terms as defined in the Integral Terms and Conditions):

    “Except to the extent such activities are expressly agreed by the parties … your rights to benefit from the Content does not permit you, or the Users, to … reproduce, publish, distribute, redistribute, broadcast, transmit, modify, adapt, edit, abstract, create derivative works of, store, archive, display in a public setting (not including your own school/college), sell, upload to a shared portal/intranet/any other website; or in any way otherwise commercially exploit any part of the Content”.

    8.8 If You use any Content in breach of this Contract, You may be prevented from attending future MEI events or accessing other MEI materials through Our website or otherwise, and You must, at Our option, return or destroy any copies of the Content that You have made.

    8.9 Views expressed by speakers, exhibitors and sponsors at the Event are their own. MEI is not responsible or liable for any advice given, or views expressed, by any speaker and/or sponsor or in any material provided.

    9. Recordings of the Event

    9.1 You must not audio or video record any part of the Event using any recording device, unless specifically agreed by Us in writing.

    9.2 Live online sessions will normally be recorded by Us, and these recordings will normally be available to all participants; Your name as it appears on Your application form will be visible to other users during the session and in the recording.

    9.3 Recordings and photographs of Events.

    a) MEI and guest speakers may make recordings or take photographs of the Event; We will process Your personal data (including Your image and recordings of Your voice) in line with our privacy notice (see clause 11.1 below). Please note that Your image may be captured in photographs and / or films of the Event, and that those photos and films may be reproduced for promotional purposes, in advertising or in podcasts in future Events.

    b) Where applicable, We will put a process in place allowing You to let Us know that You prefer that Your image is not used in this way, and will outline that process to You in the joining instructions. Please make sure that You comply with that process, if You prefer that Your image is not used.

    10. Participating in an MEI Community

    10.1 If You participate in an MEI community, You agree to uphold any community guidelines or Code of Conduct We share with You

    10.2 Failure to comply with community guidelines or Code of Conduct may result in Your restriction, suspension or removal from the community

    11. Data protection and privacy

    11.1 Any data, including personal data, that You provide to MEI in relation to the Event will be processed in accordance with MEI’s Privacy Notice

    11.2 Where appropriate, We may share Your personal data with other parties who We are contractually engaged with. In particular, We may need to share some of Your personal data with the Venue which is used to host the Event, in order that they can properly host the Event and comply with their legal and regulatory obligations. Please refer to our Privacy Notice in that regard.

    11.3 Where You are booking a place on a Course for another person (for example, for a teacher in Your organisation), You must ensure that they are provided with a copy of our Privacy Notice, in order that they have visibility of the personal data which is shared with Us, and how We use is.

    11.4 We require all third parties to whom We transfer Your data to respect the security of Your personal data and to treat it in accordance with the law. Details of how the data that You submit will be used are set out in MEI’s Privacy Notice.

    12. Our liability to You

    12.1 If you are:

    a) Consumer, We are responsible to You for foreseeable loss and damage caused by Us. If We fail to comply with these terms, We are responsible for loss or damage You suffer that is a foreseeable result of Our breaking this Contract or Our failing to use reasonable care and skill. But We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both We and You knew it might happen.

    b) not a Consumer:

    i. We will have no liability to You for any loss of profit, loss of revenue, loss of business, business interruption, or loss of business opportunity, or any indirect or consequential loss arising under or in connection with these terms or the Event, however caused; and

    ii. Our aggregate liability to You for any loss arising under or in connection with this Contract, and whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, shall in no circumstances exceed the amount of the Fee that You have paid to Us.

    12.2 No responsibility for equipment faults or failure.

    a) MEI accepts no responsibility for, and will have no liability to You in respect of, any losses incurred by You in connection with  technical faults occurring in Your centre or with faults or failure of Your IT equipment prior to or during an Event.

    b) For Fee-paying events, We reserve the right to retain the Fee in full if Your equipment fails during or before an Event and You are unable to take part. We may, at Our sole discretion, agree to provide You with a full or partial refund where We consider it reasonable to do so.

    c) It is Your responsibility to ensure that:

    i. suitable equipment is correctly set-up before the Event to enable You to attend; and

    ii. You have sought Your own support before the Event (or the first session, if the Event runs over multiple sessions) if any technical issues prevent You from accessing the online classroom and its facilities.

    12.3 We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors.

    13. Events at Your premises

    13.1 This clause 13 only applies where the Event takes place at Your premises (Centre-based Event), and all bookings of Centre-based Events will be made in a business (i.e. non-Consumer) capacity. All of the above terms and conditions also apply to such Events unless varied by terms and conditions set out below.

    13.2 After an initial enquiry has been received, a member of Our customer service team will liaise with Your centre to confirm the content and date of Your Event.  Once an Event has been confirmed by the centre, written confirmation will be provided by MEI within 72 hours.  We may arrange for materials, as appropriate to the type of Centre-based Event, to be delivered to You up to 48 hours before the Centre-based Event.

    13.3 The number of delegates must not exceed the number agreed at the time of booking unless MEI has consented to the change in advance of the Centre-based Event.

    13.4 Once the Centre-based Event is agreed, an invoice will be generated 20 days before the Centre-based Event date.  The invoice will include travel and subsistence costs for MEI’s presenter. Where Centre-based events have been agreed less than 20 days before the Centre-based Event date, an invoice will be generated as soon as possible.

    13.5 If You wish to cancel a scheduled Centre-based Event You must notify Our customer service team in writing, preferably by email to admin@mei.org.uk.

    13.6 No cancellation fee will be charged if a minimum of 20 calendar days’ notice is given prior to the date on which the Centre-based Event begins. If You cancel the Centre-based Event with less than 20 calendar days’ notice before the scheduled Centre-based Event, You will be liable for the full Fee.  Relevant expenses already incurred by MEI (for example, unrecoverable travel and accommodation costs) will be invoiced immediately when a cancellation is received, regardless of the amount of notice provided.

    13.7 In the event that the MEI presenter cannot attend on the day of the scheduled Centre-based Event (for example due to illness or adverse weather conditions), You will have the option of MEI rearranging the Centre-based Event for a later date, or receiving a full refund for that day.

    14. Other important terms

    14.1 We may update or amend these terms and conditions from time to time to comply with law or to meet our changing business requirements without notice to You. We will aim to notify You of any significant proposed change to the terms at least 30 days before making the change.  If You do not agree to such change You can contact Us on admin@mei.org.uk to end the Contract before the change takes effect, and receive a refund for any Events You have paid for but not yet attended. If You attend an Event after We have notified You of a change to these terms, that will be treated as confirmation of Your acceptance of that change.

    14.2 Each of the clauses of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

    14.3 Even if a party delays in enforcing these Terms, it can still enforce the relevant term later.

    14.4 These terms are governed by the laws of England and Wales. You can choose whether to bring a claim against Us in the courts of England and Wales or in the courts of another part of the UK in which You live.

    14.5 If You are not a Consumer, these terms constitute the entire agreement between us. You acknowledge that You have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of MEI which is not set out in these terms, and that You shall have no claim for innocent or negligent misrepresentation based on any statement in these terms.
